The migrant case law of the European Court of Human Rights : critique and way forward

Abstract
This chapter points out that the European Court of Human Rights often privileges state sovereignty over migrants' rights. It traces the origins of this deficit in protection, gives stark examples of it, and highlights possible remedies to it.
