The international legal personality of island states permanently submerged due to climate change effects

Abstract
This doctoral thesis unravels the legal consequences for the legal personality of the population of low-lying island States which will become submerged due to sea level rise. In order to assess the legal personality of the population of a State without habitable land and the rights it retains, this doctoral thesis analyzes the status and boundaries of a people’s right to self-determination as found in common article 1 of the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. Firstly, it is reviewed whether and how the people which currently exercises its right to self-determination in the form of statehood can retain its statehood when land is lost. Secondly, it is reviewed whether and how the people which is devoid of statehood can exercise non-state autonomy. Finally, the law governing sovereignty over maritime resources is studied to discern to which extent a people can retain rights to valuable maritime resources within this context.
