- Online dispute resolution (ODR) is the application of information technology to alternative dispute resolution mechanism. ODR is a suitable solution for disputes arising cross-border electronic commerce transactions for its efficiency and low cost. This dissertation explores the great potential to use ODR in resolving electronic commerce disputes by ensuring the parties' access to justice and procedural fairness in ODR. The major concerns to the development of ODR lie in the extent to which electronic ADR agreement is recognized at a cross-border level, how procedural justice is ensured in ODR proceedings, and the effectiveness of enforcement mechanism to have ODR outcomes executed. To this end, this dissertation wiil assess the role of ODR in resolving e-commerce disputes, identify legal barriers to the development of ODR, and make recommendations based on the current legal framework in the European Union and China.
