Between minimal standards and national variation : minimum harmonisation of advertising rules

Abstract
Central to this book chapter is the interplay between the minimum standards on commercial communication in the Audiovisual Media Services Directive (AVMSD) and national variations in this regard. This chapter aims to illustrate the implications and challenges pertaining to the minimum harmonisation approach underlying the AVMSD, in particular in light of the new players in the audiovisual media field. After touching upon the AVMSD's minimum standards regarding commercial communication and the goals pursued by them, this chapter focuses on the extension of the scope of the Directive to video-sharing platforms (VSPs) and user-generated content (UGC). Based on an evaluation of the minimum standards in light of these changes, a number of challenges posed to minimum harmonisation are identified. The next sections respectively discuss alternative regulatory instruments and enforcement through the lens of minimum harmonisation. The chapter concludes with the advantages and disadvantages of minimum harmonisation in the dynamic audiovisual media market of today.
