Don’t count your codes before they hatch : a theoretical and empirical analysis of codes of conduct under the General Data Protection Regulation

Abstract
The European Union’s General Data Protection Regulation (GDPR) encourages the development of ‘codes of conduct’ in its articles 40-41. Although institutional actors and corporate stakeholders have expressed great interest in such tools, there are still few of them. Additionally, scholarly research on these instruments is underdeveloped. The doctoral research investigates 1) the legal characteristics of GDPR codes of conduct, 2) how GDPR codes of conduct are implemented in practice, and 3) whether GDPR codes of conduct contribute to the convergence or divergence of global data protection standards. Future developments regarding codes of conduct in the Digital Services Act and the Artificial Intelligence Act are also discussed.
