The analysis of issues and solutions in recognition and enforcement of mainland civil and commercial judgments in Taiwan

Abstract
台湾地区"最高法院"于2007年作出第2531号判决并否认大陆人民法院判决具有既判力,此后,大陆人民法院判决在台湾地区难以得到认可与执行,致使诉讼当事人的司法救济途径被束之高阁。本文以第2531号判决为切入点,分析大陆人民法院判决在台湾地区认可与执行中的障碍,即判决的既判力问题、公共秩序保留的适用问题以及认可模式的选择问题。通过推动台湾地区"最高法院"作出新的判决、修订"两岸人民关系条例"第74条以及建立两岸司法互助机制,以贯通两岸间法院判决的认可与执行路径。
