Abstract
Parental separation leads to many changes in children's family life. Despite these changes, the perspective of children can be neglected during child custody and contact proceedings and amicable negotiations. Professionals wish to protect and shelter children from the court and shield them from the parental conflict. However, neglecting the child's perspective can harm the child's well-being. Therefore, this research investigates how child-friendly justice can be achieved in child custody and contact cases, by taking into account the child's best interests, the child's right to be heard, the child's right to maintain contact with both parents and the child's psychosocial well-being. The research incorporates interdisciplinary research, the perspective of family judges and children and offers recommendations to policy-makers and family judges.
