Jorens, Yves2023This is the conference book for the XIV European Regional Congress of the International Society for Labour and Social Security Law, dedicated to the interactions between social law and other areas of law. In recent years, labour law and social security law have been subject to various reforms and developments. Social law is however not an isolated domain but rather interacts with other fields, often even functioning as a guide or giving direction to those lost at sea. In other words: serving as a lighthouse.
The key aspect addressed in this book is the existence of a connection between social law sensu stricto (labour law and social security law) and other areas of law. Pursuing an inter- and multidisciplinary approach, it gathers contributions on topical and challenging issues in four broad areas:
1. Basic and fundamental principles of European social law
2. The future in the light of the past
3. The impact of regionalisation
4. Enforcement in social law
In turn, various developments can be identified in connection with these topics: the emergence of social criminal law is creating new overlaps between social and criminal law; the growing number of administrative law sanctions offers new insights into and connections between social security law and administrative law; the increasing similarity of employment in the public and private sectors raises questions about the applicability of administrative law in labour law relations; the relation between the ECHR and the articles of the Constitution opens up new perspectives on the constitutional interpretation of freedoms and on the interaction between human rights, constitutional law and social law; and lastly, there is a growing influence of EU law and international treaty law (concerning trade) on social law. Can we, by looking at these developments, draw certain conclusions at a different and innovative level? Jorens, YvesSchepens, Pieterjan2023The history of Belgian pensions legislation for the private sector is commonly divided into a ‘capitalization period’, running from 1924 to 1955, and a ‘repartition period’, stretching from 1955 until the present. This conceptualization is attractive in that is follows one of the most fundamental dichotomies in pensions research, whereby pensions schemes are categorized according to the manner of their financing. In this contribution it is however argued that the existence of a ‘capitalization period’ cannot be treated as a factual given. The actual degree of capitalization following 1924 was quite low. Moreover, a provisional ‘repartition scheme’ legislated in 1920 turns out to conceal a significant amount of capitalization. Far from doing away with the dichotomy entirely however, tracing how capitalization and repartition were woven into this early legislation will help us to understand the real priorities of the era. Fundamentally, the Belgian legislator in the 1920s was faced with a choice between whether to link pensions to poverty or to a personal contribution. Parliament opted decisively for the latter. This choice has largely held to this day. In this way, rather than seeing the 1950s as the birth of the modern Belgian pensions system, Belgium’s most fundamental choice was made decades earlier. Jackson, Andrew L. R.Schoukens, Hendrik2023Environmental litigation has turned into an uncompromising battleground where scientific controversies are rife. In this chapter, it is argued that the Court of Justice of the EU (CJEU) has opted for a progressive middle road when addressing scientific questions under the Habitats Directive. Over the past decade or so, the CJEU has persistently advocated the use of science-based decision-making procedures when implementing the Habitats Directive, and the importance of precise and conclusive scientific data. When such information is not available, the precautionary principle urges the competent authorities to deny permit or derogation applications for unsustainable practices. Indirectly, the CJEU has thereby turned the Habitats Directive into a highly effective legal instrument against harmful plans and projects. Yet as science is always in flux, this pragmatic attitude also has its downsides since it is premised on the idea that ‘science’ is always rational and objective. Österreichische Post AG, clarifying when an individual can claim compensation for damages under Article 82(1) of the General Data Protection Regulation. According to the ECJ, the mere infringement of the provisions of the GDPR is not, in and of itself, sufficient to establish a right to compensation to individuals: Individuals must have suffered material or nonmaterial damages from an infringement of the GDPR. At the same time, the degree of seriousness of such damage is irrelevant for the establishment of the right to compensation. Finally, compensation is calculated pursuant to domestic law. Olani, Amanti Baru2024Background: This study examines the opinions of khat-chewers and local social service providers about the current regulatory framework for khat and their preferred policy option(s).
Methods: Interviews were conducted with 102 khat-chewing individuals, five habitual groups, and ten social service providers in Jimma, Ethiopia.
Results: Most of the participants believe that neither laissez-faire nor prohibition policies are appropriate. Reasons for supporting the reform of the current laissez-faire approach include: worries about the escalating use of khat, concerns about the safety of the khat supply, the adverse effects of khat on the city’s aesthetics and hygiene, and negative impacts on economic security. Reasons for opposing the introduction of a policy of prohibition include: prohibition would be counterproductive, and it would undermine the socioeconomic significance of khat. However, the study participants did suggest several regulatory activities, which can be thematized into primary
and secondary preventive strategies.
Conclusion: The preferred regulatory approaches include addressing the structural causes of (problematic) khat use, empowering khat-chewers with awareness about appropriate use, managing the supply of khat, and restricting the age of users and place of use. Om dit te bevorderen, worden er platformen gebouwd die via technologische vooruitgang onderzoeksgegevens makkelijker vindbaar, toegankelijk en herbruikbaar kunnen maken. Deze platformen zijn echter niet in staat om alle barrières die de uitwisseling beperken te laten verdwijnen. Verscheidene factoren, zoals controleverlies, het vermijden van vermeende reputatieschade, de nood om wetenschappelijke gegevens correct te interpreteren, kortetermijncycli voor het verkrijgen van fondsen, de tijdskost die gepaard gaat met gegevensuitwisseling, de gebrekkige erkenningssystemen voor het verzamelen van data, alsook ethische en wettelijke beperkingen, kunnen de uitwisseling verhinderen. De rol van de platformen zal in essentie afhangen van de gemeenschappelijke visie op de fundamentele spelregels rond gegevensuitwisseling en wetenschappelijke competitie.
